Cestovní kanceláře požadují nezákonné storno poplatky

Zákazníci mohou ze zákona od cestovní smlouvy kdykoliv před zahájením zájezdu odstoupit a cestovní kancelář si pro tyto případy může vyhradit odstupné, známé spíše jako storno poplatky. Z průzkumu spotřebitelského časopisu dTest však vyplývá, že cestovní kanceláře při stanovování jejich výše nerespektují zákon a v mnohých případech požadují poplatky nepřiměřeně vysoké.
Spotřebitelský časopis dTest provedl průzkum smluvních podmínek sedmi velkých cestovních kanceláří působících v České republice. V oblasti tzv. storno poplatků, tedy částky, kterou spotřebitel platí při zrušení zájezdu, ale dospěl k nelichotivým závěrům: „Všechny z testovaných cestovních kanceláří si v určitém období před předpokládaným zahájením zájezdu vyhrazují storno poplatky ve výši 100 % z ceny zájezdu, což považujeme za nezákonné,“ říká Martina Vernerová, právní poradkyně časopisu dTest.
Takto stanovené storno poplatky jsou nepřiměřeně vysoké, jednostranné ve prospěch cestovních kanceláří a nečiní jakýkoliv rozdíl mezí tím, zda zájezd absolvujete či nikoliv. „S trochou nadsázky můžeme říci, že na zájezdu, na kterém nebudete, nic nesníte, nikdo vám nebude uklízet pokoj a ulehčíte letadlu i delegátovi. Navíc pádným argumentem je, že v dnešní době nebývá problém uvolněný zájezd znovu prodat jako tzv. last minute, byť za nižší cenu,“ vysvětluje Vernerová nepřiměřenost poplatků ve výši 100 % ceny zájezdu.
Cestovní kanceláře určují výši storno poplatků podle toho, v jak dlouhé době před odjezdem zákazník zájezd zruší. Poplatky ve výši 100 % z ceny zájezdu uplatňují v průměru od čtvrtého dne před zahájením zájezdu. Dále je vhodné požadovat doložení reálných nákladů a ztráty, které cestovní kancelář naším odstoupením skutečně utrpěla a na jejíž úhradu má tedy právo,“ uzavírá Vernerová.
